Terms of Service
These Terms of Service (hereinafter referred to as the "Terms") define the conditions for using the services (hereinafter referred to as the "Services") provided by ALLSTARS Inc. (hereinafter referred to as the "Company") on this website. All registered users (hereinafter referred to as "Users") shall use the Services in accordance with these Terms.
Article 1Scope and Applicability
These Terms shall apply to all relationships between Users and the Company regarding the use of the Services.
In addition to these Terms, the Company may establish rules and individual provisions (hereinafter referred to as "Individual Provisions") regarding the use of the Services. Regardless of their names, these Individual Provisions shall constitute a part of these Terms.
If any provision of these Terms conflicts with the provisions of Individual Provisions, the Individual Provisions shall take precedence unless otherwise specified.
Article 2User Registration
User registration shall be completed when an applicant agrees to these Terms, applies for registration through the method prescribed by the Company, and the Company approves the application.
The Company may decline to approve an application for user registration without any obligation to disclose the reason if it determines that the applicant falls under any of the following:
- False information was provided during registration application.
- The application is made by a person who has previously violated these Terms.
- Other circumstances where the Company deems registration inappropriate.
Article 3Management of User ID and Password
Users shall properly manage their User ID and password for the Services at their own responsibility.
Under no circumstances may Users transfer, lend, or share their User ID and password with any third party. If a login occurs with a User ID and password combination matching registered details, the Company considers it as use by the registered user themselves.
The Company assumes no liability for damages caused by third-party use of User IDs and passwords, except in cases of intentional misconduct or gross negligence by the Company.
Article 4Fees and Payment Methods
Users shall pay the service fees separately specified by the Company and displayed on this website for paid parts of the Services using methods designated by the Company.
If a User delays payment of service fees, the User shall pay late charge damages at a rate of 14.6% per annum.
Article 5Prohibited Conduct
When using the Services, Users shall not engage in any of the following acts:
- Acts that violate laws, public order, or moral standards.
- Acts related to criminal activities.
- Acts infringing on copyrights, trademarks, or other intellectual property rights contained in the Services.
- Acts that destroy or interfere with the server or network functions of the Company, other users, or third parties.
- Commercial utilization of information obtained through the Services.
- Acts that may interfere with the operation of the Company's services.
- Unauthorized access or attempts thereof.
- Collecting or accumulating personal information about other users.
- Using the Services for improper purposes.
- Acts causing disadvantage, damage, or discomfort to other users or third parties.
- Impersonating other users.
- Advertising, soliciting, or business activities on the Services not permitted by the Company.
- Acts aimed at meeting unfamiliar members of the opposite sex.
- Providing direct or indirect benefits to anti-social forces in relation to the Company's services.
- Other acts deemed inappropriate by the Company.
Article 6Suspension of Service Provision
The Company may suspend or interrupt the provision of all or part of the Services without prior notice to Users if it determines that any of the following reasons exist:
- Maintenance or updates of the computer systems related to the Services.
- When service provision becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.
- When computers or communication lines stop operating due to accidents.
- Other cases where the Company deems service provision difficult.
- When preparing necessary and appropriate frameworks to prevent information leakage, loss, or damage.
The Company shall not be liable for any disadvantage or damage incurred by Users or third parties due to the suspension or interruption of the Services.
Article 7Usage Restriction and Registration Cancellation
The Company may restrict all or part of the Services or cancel user registration without prior notice if the User falls under any of the following:
- Violation of any provision of these Terms.
- Discovery of false facts in registration information.
- Default on payment obligations such as fees.
- Failure to respond to communications from the Company for a reasonable period.
- No record of service usage for a certain period since last access.
- Other cases where the Company deems usage inappropriate.
The Company assumes no liability for damages incurred by Users as a result of actions taken under this Article.
Article 8Withdrawal
Users may withdraw from the Services through the withdrawal procedures specified by the Company.
Article 9Disclaimer and Limitation of Liability
The Company does not explicitly or implicitly warrant that the Services are free of factual or legal defects (including safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security flaws, errors, bugs, or infringement of rights).
The Company assumes no liability for any damages incurred by Users arising from the Services. However, if the contract between the Company and the User regarding the Services (including these Terms) qualifies as a consumer contract under the Consumer Contract Act, this disclaimer shall not apply.
Even in cases specified in the proviso of the preceding paragraph, the Company shall not be liable for damages arising from special circumstances caused by default or tort due to negligence (excluding gross negligence) by the Company. In addition, compensation for damages shall be capped at the amount of usage fees received from the User in the month the damage occurred.
The Company assumes no responsibility for transactions, communications, or disputes arising between Users or between a User and a third party in connection with the Services.
Article 10Changes to Service Contents
The Company may change the content of the Services or discontinue service provision without notice to Users, and shall not be liable for any damages incurred by Users as a result.
Article 11Modification of Terms
The Company may modify these Terms at any time without notice to Users if deemed necessary. If a User uses the Services after changes to these Terms, the User shall be deemed to have agreed to the modified Terms.
Article 12Handling of Personal Information
The Company shall appropriately handle personal information obtained through the use of the Services in accordance with its Privacy Policy.
Article 13Notices and Communications
Notices or communications between Users and the Company shall be conducted through methods specified by the Company. Unless a User submits a change notice in accordance with the method specified separately, current contact information shall be deemed valid, and notifications sent shall be deemed delivered upon transmission.
Article 14Prohibition of Assignment of Rights and Obligations
Users may not assign or pledge to a third party their status under the usage contract or any rights or obligations based on these Terms without the prior written consent of the Company.
Article 15Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan.
In the event of any dispute regarding the Services, the court having jurisdiction over the location of the Company's head office shall have exclusive agreed jurisdiction.
